Acceptable Use Policy
What you can and cannot do on our site
This policy sets out the ground rules between you and us for accessing our website. It applies to every user and every visitor to the site.
Using the site counts as your acceptance of everything in this policy, which runs alongside our Terms of Website Use.
The site is operated by BrainFuel Ltd(“we”). We are registered in England and Wales under company number 17142548, with a registered office at 128 City Road, London, EC1V 2NX.
PROHIBITED USES
The site is for lawful use only. Do not use it:
- in any way that breaches a local, national, or international law or regulation;
- for anything unlawful or fraudulent, or anything with an unlawful or fraudulent purpose or effect;
- to harm or attempt to harm minors in any way;
- to send, receive, upload, download, use, or re-use any material that falls short of our content standards;
- to send — or arrange the sending of — unsolicited or unauthorised advertising, promotional material, or anything similar (spam);
- to knowingly transmit data or upload material containing viruses, Trojans, worms, time bombs, keystroke loggers, spyware, adware, or any other harmful code meant to disrupt computer hardware or software.
You also agree:
- not to reproduce, duplicate, copy, or resell any part of the site in ways that breach our Terms of Website Use; and
- not to access, interfere with, damage, or disrupt without authority:
- any part of the site;
- any equipment or network where the site is stored;
- any software used to run the site; or
- any equipment, network, or software owned or operated by a third party.
INTERACTIVE SERVICES
From time to time we may run interactive features on the site, including but not limited to:
- chat rooms;
- bulletin boards;
- blogs;
- surveys.
When we do, we will be clear about what the service is, whether it is moderated, and what form any moderation takes (human, automated, or both).
We will do our best to weigh up the possible risks to users (and particularly to children) from third parties using any interactive feature we run, and we will decide case by case whether moderation is right — and what kind of moderation fits the risk. However, we are under no obligation to oversee, monitor, or moderate anything interactive on the site, and we expressly rule out liability for loss or damage caused by anyone using an interactive service in a way that breaks our content standards, whether that service is moderated or not.
A minor may only use an interactive service if a parent or guardian has agreed. We strongly encourage parents who allow that to talk with their children about staying safe online, because moderation is never foolproof. Minors using an interactive service should be aware of the risks involved.
Where a service is moderated, we will usually give you a way to reach the moderator if you have a concern or difficulty.
CONTENT STANDARDS
These standards cover every contribution you make to the site and every interactive service attached to it.
You must follow both the spirit and the letter of the rules below. They apply to every part of a contribution as well as to the whole.
Contributions must:
- be accurate where they state facts;
- be genuinely held where they state opinions;
- comply with applicable law in the UK and in any country from which they are posted.
Contributions must not:
- contain anything defamatory about another person;
- contain anything obscene, offensive, hateful, or inflammatory;
- promote sexually explicit material;
- promote violence;
- promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;
- infringe any copyright, database right, or trade mark belonging to someone else;
- be likely to deceive;
- breach a legal duty owed to a third party — for example a contractual duty or a duty of confidence;
- promote anything illegal;
- be threatening, abusive, or an invasion of someone else’s privacy, or cause annoyance, inconvenience, or needless anxiety;
- be likely to harass, upset, embarrass, alarm, or annoy;
- impersonate another person or misrepresent who you are or who you are affiliated with;
- give the impression they come from us when they do not;
- encourage, promote, or help anyone carry out an unlawful act — copyright infringement or computer misuse, for example.
SUSPENSION AND TERMINATION
Whether this policy has been breached is for us to decide, and we use our own judgement. Where we find a breach we may take whatever action we consider appropriate.
Failing to follow this policy is treated as a material breach of the Terms of Website Use under which you are allowed to use the site, and may result in one or more of the following:
- immediate, temporary, or permanent withdrawal of your right to use the site;
- immediate, temporary, or permanent removal of anything you have posted or uploaded to it;
- a warning issued to you;
- legal action for reimbursement of every cost (including, but not limited to, reasonable administrative and legal fees) incurred because of the breach, on an indemnity basis;
- further legal action against you;
- disclosure of any information to law enforcement as we reasonably think necessary.
We exclude liability for whatever action we take in response to a breach of this policy. The responses above are not an exhaustive list — we may take any other step we reasonably think is right.
CHANGES TO THIS POLICY
We may update this policy at any time by editing this page. Because any change is binding on you, please check back every so often. Some provisions may also be replaced by notices or rules posted elsewhere on the site.
